Notice of Privacy Practices
Effective Date: January 1, 2026 

 

THIS NOTICE DESCRIBES HOW YOUR PROTECTED HEALTH INFORMATION (PHI) MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY. 

 

I. How We May Use and Disclose Health Information

  • Treatment: We may use your PHI to provide, coordinate, or manage your mental health care.

  • Payment: We may use/disclose your info to bill and collect payment from you, an insurance company, or third party.

  • Operations: We may use your PHI for quality assessment, training, and internal compliance.

  • Required by Law: We may disclose information when required by state or federal law, including in response to a court order or subpoena.

  • Safety Exceptions: We may disclose PHI to prevent a serious threat to your health and safety or the health and safety of others. 

II. Your Rights Regarding Your Health Information

  • Right to Inspect and Copy: You have the right to inspect and obtain a copy of your records, subject to Texas law, which may include reasonable, cost-based fees.

  • Right to Amend: You may request to amend records you believe are incorrect.

  • Right to Accounting: You may request a list of certain disclosures.

  • Right to Restrictions: You may request restrictions on how we use your information.

  • Right to Confidential Communication: You may request to be contacted at a specific phone number or address. 

III. Special Protections for Substance Use Records (Updated 2026) 

  • Your substance use disorder records are protected under federal law and cannot be re-disclosed without your written authorization. 

IV. Complaints

  • If you believe your privacy rights have been violated, you may file a complaint with our office or with the U.S. Department of Health and Human Services. 

Texas-Specific Requirements (HB 300)

Texas law requires that if you are a "covered entity" under HB 300, you must specifically inform any patients / clients that their health information may be subject to electronic disclosure.
